By accessing or using our application and service, you agree to be bound by these terms of use ("Terms of Service"). These Terms of Service affect your legal rights and obligations. If you do not agree to be bound by all of these Terms of Use, do not access or use the Service.
Certain features of our Services may be subject to additional guidelines, terms, or rules, which will be posted with those features and we reserve the right to modify, suspend, or discontinue these Services (or any portions of them) at any time.
The term "service" in this clause refers to the network acceleration service provided by the application program and the related technical support service. The user has the right to use the related products legally within the service period.
It is NOT a service for the commission of criminal acts. It is an anonymity and privacy service. You agree not to violate any laws of any jurisdiction you are originating from, or terminating into.
You agree not to use the system for sending spam, port scanning, scanning for open proxies or open relays, sending opt-in email, unsolicited email or any type or version of email sent in large quantities even if the email is ultimately sent off of another server. You agree not to launch any pop-ups from our service. You agree not to attack in any way shape or form any other computer or network while on our service.
Actual service coverage, speeds, locations and quality may vary. The Service will attempt to be available at all times except for limited periods for maintenance and repair. However, the Service may be subject to unavailability for a variety of factors beyond our control including emergencies, third party service failures, transmission, equipment or network problems or limitations, interference, signal strength, and may be interrupted, refused, limited or curtailed. We are not responsible for data, messages or pages lost, not delivered, delayed or misdirected because of interruptions or performance issues with the Service or communications services or networks (e.g., T-1 lines or the Internet). We may impose usage or Service limits, suspend Service, or block certain kinds of usage in our sole discretion to protect users or the Service. Network speed is an estimate and is no indication of the speed at which you or the Service sends or receives data. Actual network speed will vary based on configuration, compression, network congestion and other factors. The accuracy and timeliness of data received is not guaranteed; delays or omissions may occur.
Hacking, cracking, distribution of viruses, fraudulent activities, network sabotage, phishing, and/or any conduct deemed illegal or unwanted shall be subject to suspension or termination. Users are responsible for the proper secure configuration of their services and are responsible for any damages caused by their neglect or exposure of vulnerabilities whether intentional or unintentional.
In any event application will never be liable for any monetary harm beyond what the client paid to application and this shall not include attorney fees or court costs irrespective of any laws or statues that may be treated otherwise. This is our obligatory agreement when you accept these terms of service.
Without limiting the foregoing, you agree that you will not use the Services in any manner or transmit any Submission that:
Posts, stores, transmits, offers, or solicits anything that contains the following, or that you know contains links to the following or to locations that in turn contain links to the following:
(a) Material that we determine to be offensive (including material promoting or glorifying hate, violence, bigotry, or any entity (past or present) principally dedicated to such causes or items associated with such an entity).
(b) Material that is racially or ethnically insensitive, material that is defamatory, harassing or threatening.
(c) Pornography (including any obscene material, and anything depicting children in sexually suggestive situations whether or not depicting actual children) or may be harmful to a minor.
(d) Any virus, worm, Trojan horse, or other harmful or disruptive component.
(e) Anything that encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law or regulation or is otherwise inappropriate.
Restricts or inhibits use of the Site and/or the Application.
Uses any account or password without prior permission.
Obtains or solicits another person’s password or other personal information under false pretenses. Impersonates another user or otherwise misrepresents yourself in any manner, whether to another user, to us, or otherwise.
Violates the legal rights of others, including defaming, abuse, stalking or threatening users.
Infringes (or results in the infringement of) VPN App’s or any third party’s intellectual property rights, moral rights, or other rights.
Is (or you reasonably believe to be illegal, fraudulent, or unauthorized, or in furtherance of any illegal, counterfeiting, fraudulent, pirating, unauthorized, or violent activity, or that involves (or you reasonably believe to involve) any stolen, illegal, counterfeit, fraudulent, pirated, or unauthorized material.
Does not comply with all applicable laws, rules, or regulations, including obtaining all necessary permits, licenses, registrations, etc. In the case of any proposed or actual transaction, "applicable" refers to both your own location and to location(s) of all other parties to the transaction; or would cause VPN app to be in violation of any law, ordinance, rule, regulation or treaty, or to infringe any right of any third party;
Publishes falsehoods or misrepresentations that may damage VPN App or any third party;
Manipulates identifiers, forges headers or other data in order to disguise the origin of content transmitted through our sites or to manipulate your presence on the Services;
Disrupts, interferes or harms the Services, servers or networks, or imposes an unreasonably or disproportionately large load on our infrastructure.
In addition, you may not use the Services to post, store, or transmit advertising, promotional material, or solicitations of goods or services, except in areas of the Services designated for the purpose, such as those designated for Commercial Users.
Criminal Activity – any client who commits any of these criminal actions: use of stolen credit cards, credit card fraud, PayPal fraud, bank fraud, e-gold fraud, Paysera fraud, WebMoney fraud, Bitcoin fraud, mail fraud, extortion, blackmail, kidnapping, rape, murder, sale of stolen credit cards, sale of stolen goods, sending email or operating websites to perform identity theft, hacking, pharming, phishing, spamming of any form on, in or through our service using our resources leaves with a terminated account.
VPN App in its sole discretion may choose to provide users with "Premium Content". The purchase of Premium Content shall be subject to the payment of fees to VPN App, which VPN App may determine from time to time in its sole discretion ("Premium Fees"). If you elect to pay for any Premium Content on a monthly recurring basis, you are authorizing us to charge your designated payment method on a recurring basis. You may update any of your billing information (including a change to your desired billing payment method) through your account settings on the Site/App Store. Your subscription will automatically renew at the then-current fee, unless you cancel your subscription in the "Billing" section of your account settings. You will be charged on the date you sign up on a recurring basis for the period ending on the last day of the then-current month, and subsequently, you will be charged on or around the last day of each month for the immediately following monthly subscription term.
VPN App may, from time to time, modify, amend, or supplement its pricing and billing procedures, and such changes shall be effective immediately upon posting an update of these Terms or posting such changes elsewhere on the App. If you do not accept the new changes, you should terminate your subscription immediately. If there is a dispute regarding your payment of fees, or the Service, VPN App shall have the right to terminate your account without prior notice. All Premium Fees are exclusive of any sales and use taxes, which shall be your responsibility and liability.
We reserve the right to terminate any user account for violating terms of service instantly without refund and notice or suspend the account until clarification, investigation or the user comment. If your account has been suspended you must contact us in order to see if the case can be rectified. We shall wait a substantiated period of time before we close a user account permanently and shut down all billing.
We do not log any user activity (sites visited, DNS lookups, emails etc.) We only log access attempts to our servers (for security and troubleshooting). We do not get involved in any form of censorship. We do not give your personal info to any third parties. We do not cooperate with any requests for information unless we are ordered by a court of competent jurisdiction and the vast majority of these requests would not be from a court of competent jurisdiction We will protect you to the max and our system is setup to automatically do so. There are hundreds of good reasons for being anonymous and we respect them fully.
These Terms constitute the entire agreement between us with respect to the subject matter and supersedes and merges any prior proposals, understandings and contemporaneous communications. These Terms may be amended by us from time to time. If we make material changes to these Terms, we will notify you by posting the revised Terms or notifying you through the Services or your account. Your continued use of the Services after the changes go into effect will constitute your agreement to such changes.
